Majelis Hakim Pengadilan Tipikor menyatakan La Nyalla tidak bersalah sebagaimana dakwaan dan tuntutan jaksa penuntut umum (JPU).
Ia bebas murni (vrijspraak). Tetapi, dari lima hakim anggota majelis, dua hakim berpendapat beda (disenting opinion). Keduanya memutuskan La Nyalla terbukti bersalah.
Maruli menyebut, dua hakim yang menyatakan La Nyalla bersalah ialah hakim Ad Hoc. Sementara tiga hakim yang menyatakan La Nyalla tidak bersalah adalah hakim karir.
"Dua hakim Ad Hoc yang sependapat dengan JPU, sementara tiga hakim yang tidak sepakat semuanya hakim karir. Ya, bisa diartikan sendirilah. Pikir sendiri," sebut Maruli.Walau vonis bebas, Maruli tetap menghormati putusan yang ada. Bahkan ia mempertimbangkan upaya hukum atas vonis bebas La Nyalla.
"Kami masih ada waktu 14 hari untuk melakukan upaya hukum," ucapnya.Apakah ada unsur lain dalam putusan hakim? Maruli enggan berkomentar, namun yang jelas kata dia bahwa publik bisa mengetahui sejak penyidikan kasus ini.
"Kalau soal unsur lain, sejak proses penyidikan kan sudah pada tahu, sampai praperadilan lima kali," jelas Maruli.Sebelumnya, La Nyalla dituntut jaksa selama 6 tahun penjara. Dalam dakwaaan, La Nyalla melakukan tindak pidana korupsi dengan memperkaya diri sendiri dengan total Rp 1,1 miliar.
Modusnya menjual saham Bank Jatim yang dibelinya dengan menggunakan dana hibah Pemprov Jatim kepada Kadin Jatim dengan harga yang lebih tinggi.
